Waiver and Indemnity

I {name-1-first-name} {name-1-last-name} acknowledge and agree that power dinghy racing (‘PDR’) as organised and facilitated by the club is a dangerous recreational activity involving many dangers and hazards (including but not limited to fires, collisions and capsizing) which may give rise to a significant risk of personal injury and even death and that such dangers and hazards and the attendant risk of injury or even death are obvious to me.
Further and/or in the alternative, I {name-1-first-name} {name-1-last-name} acknowledge and agree that PDR is a recreational activity which involves many dangers and hazards (including but not limited to fires, collisions and capsizing) which may give rise to a risk of personal injury and even death and that I have been warned of the said dangers and hazards and the attendant risk of injury and even death.
I {name-1-first-name} {name-1-last-name} agree and accept that my participation in PDR with its many dangers and hazards which give rise to the risk of personal injury and even death is at my own risk.
I {name-1-first-name} {name-1-last-name} further agree that should I suffer personal injury as a consequence of my participation in PDR, I waive any and all rights I might otherwise have to pursue a claim or claims:

a) in contract on the basis that PRD, being recreational services
organised and facilitated by the club, were not provided with
due care and skill;

b) that the said recreational services were not fit for any
particular purpose I made known to the club, or that the said
services provided by the club did not achieve any result that I
may have made known to the club; and

c) on the basis that the club and/or its officers, employees and
members acted negligently or in breach of some other tort.
I {name-1-first-name} {name-1-last-name} agree to indemnify the club and its officers, employees and members against any losses, costs, damages, expenses and liabilities sustained or incurred by the club and/or its officers, employees and members in connection with any claim, action, demand or proceedings, whether based in contract, tort or otherwise, by any person in regard to or arising out of any personal injuries sustained by me as a result of engaging in PDR.

PDRC Code of Conduct

Power Dinghy Racing Club of WA endorses the following code of conduct
for our members.

This code of conduct is underpinned by the following core values.

To act within the rules and spirit of our sport.
To display respect and courtesy towards everyone involved in our sport noting that everyone in a organisational role is doing so as a volunteer.
To prioritise the encouragement and safety of new and junior members into our sport.

A member shall:

Respect the rights, dignity and worth of others.
Be fair, considerate and honest in all dealing with others.
Be professional in, and accept responsibility for, your actions.
Be aware of, and maintain an uncompromising understanding of and adhesion to, Power Dinghy Racing Club of WA Constitution ,
Competition Rules, Specifications documents.
Act in a way that provides a good example to junior and new members to the club.
Refrain from any form of harassment of others.
Refrain from any behaviour that may bring the Power Dinghy Racing Club of WA into disrepute.
Provide a safe environment for the conduct of racing power dinghies and training.
Be a positive role model.
Understand that race teams are responsible for the behaviour and actions of their support crew and affiliates at race events and weekends away with the club.
Be aware of the constitution paragraph 20. “Discipline” specifically 20.1 relating to “reasons”
Understand that the competition rules and specifications documents are the responsibility of all members utilise the rule proposal process to maintain workable documents for the current racing format.
Understand that it is management committees responsibility to to uphold the rulebook as it reads.
